Can States Rewrite The Constitution?

Almost two years ago, a bill was pushed by former California Governor Jerry Brown to force candidates running for president to make their tax returns public. This big issue was fiercely fought back by Republicans and President Trump. The reason, the bill fell through wasn’t just because of the Democrat’s stupidity, it was because there was something backing Republicans and President Trump, The United States of America Constitution, in all her glory. Now we find ourselves two years later, Governor Gavin Newsom of the Golden State is trying to pull the same stunt.

The bill is almost identical to the one Democrats tried to push through, and Governor Newsom has fewer than two weeks to determine what to do with the proposed law. Conservatives are furious this is even being considered after the first bill failed.

California State Senators Scott Wiener and Mike McGuire are the authors of this horrendous bill. They told CBS News, “It was disappointing for a lot of people not to be able to have confidence that a major presidential candidate, and ultimately the president, didn’t have financial conflicts of interest. I think it’s time to require what everyone already thought was required.” No, what was disappointing was Democrats could not get over the fact Donald Trump was president and was fixing to “drain the swamp.” They tried everything they could do to get rid of the president to no avail. They are still trying and cannot get it done. They call this new “revised” bill, “Presidential Tax Transparency and Accountability Act.”

This bill requests all presidential candidates to show the last five years of their filed tax returns. The current bill is still on the governor’s desk as he wanted the bill to include the governor’s seat as well. He told reporters Friday, “I was solicitous of amending it to include the governor. So, that’s maybe suggestive of an inclination. But I haven’t made the determination.”

What makes this bill so funny is, wouldn’t people just love to see the Democratic side of tax returns as well. Even though the bill is unconstitutional, it would be hilarious because there are many Democrats who would burn themselves in the process. I find this rather amusing because Democrats have proven countless times they do not think issues all the way through. This is why they get burned and exposed every time.

The strongest argument in the Conservatives’ favor is, Democrats cannot discard or rewrite the Constitution. Conservatives are letting Democrats know. California Republican Party Chairwoman Jessica Patterson stated, “I urge Gov. Gavin Newsom to veto this unconstitutional bill, and I encourage Democrats in the Legislature to drop the political posturing and focus on addressing the myriad of problems truly impacting Californians.”

Tim Murtaugh, the director of the Trump campaign communications told CBS News, “The Constitution is clear on the qualifications for someone to serve as president and states cannot add additional requirements on their own. The bill also violates the 1st Amendment right of association since California can’t tell political parties which candidates their members can or cannot vote for in a primary election.”

Mike McGuire blew off the argument stating it was “hogwash” that his bill was deemed “unconstitutional.” The dumbass even went as far to tell CBS News, “It’s an easy soundbite to say it’s unconstitutional. But this is bill is based on data and fact, not soundbites. We believe that we will withstand any constitutional tests. And, candidly, I say bring it on.”

If it is a challenge he wants, well he does not know how much conservatives are educated, because McGuire obviously is not. The Supreme Court ruled in 1994 when challenged in Arkansas, “States could not add on their own qualifications for congressional candidates.”

Six years later in 2000, it was declared unconstitutional for “creating an absolute bar to candidates, who otherwise meet the requirements of the Qualifications Clause.” The 9th U.S. Circuit Court of Appeals made this ruling.

The Republican party in California and the Trump campaign declined to comment if Newsom decided to sign this unconstitutional bill if they would duke it out in the courtrooms. The best thing is to remain silent and never let the enemy know what you are doing or going to do. This is where Democrats always falter and end up putting their foot in their mouths. They are trying to get Trump off the California ballot. With the little to no competition in the Golden State, does it really matter?

  27. I think States can propose amendments in certain circumstances. If enough states wanted an amendment that would limit “terms” of Congressional members it could be offered and eventually ratified by the state legislators. I think this is the only way that term limits would ever get passed or even considered by our Congress and Senate.

  28. It will require a Constitutional amendment that is submitted to both houses of congress. From there it must go through the amendment approval process. Good luck with that! Democrats don’t understand how these things work. They do no research on their subject and have no clue what they are doing.

    All I can say is where do all these supposed educated ignorant people come from? Sanctuary cities are illegal. Criminals are aided and abetted to keep them from being prosecuted or deported to the detriment of the citizen population. To me, that is treason. We have got to stop this nonsense!!

  30. California Democratic leadership should be arrested for destroying one the best states in the Union. Somehow they have managed to make a slum out what was a great place to live. Disgusting. In the mix is the fact that they, Seattle, Portland, NY are all significantly raising the threat of serious and pandemic disease to all of us. Don’t know how those people stay in power.

If they did pass such a bill you know that the RNC would challenge it in the fed courts in a heartbeat because Fed Election laws are just that Federal made by Congress and no State law can overrule a Fed law thus such a bill would be ruled as unconstitutional by the U.S.Supreme court and be struck down and CA would be forced to remove it.

  35. California should just leave the union. They have no respect for the Federal aw, or the federal government. California become your own little country, Close down our military installations in California, and send these installations to other parts of the U. S. I am sure other states could use the economic boost. Once California becomes their own little country, they then can get annexed by Mexico. Once California leaves the Union that will be the end of all liberal commie democrats in the House, from California, Newsom than can become Governor of the California Territory, and he can answer to Mexico.

  36. If CA doesn’t like our constitution then get out of the Union and form your own country. It would save the rest of us millions if not billions of dollars and they would end up funding the illegals in their state without the help of the r est of the nation. While it’s true CA would not be paying federal taxes it’s also true that they would not be receiving money from the federal government. Maybe they should think about that before they try to pass unconstitutional laws.

  37. I’m not worried about Trumps taxes, he’s doing a great job. Trump is not anti-American, but obama was anti-American. Obama did not have American values, he promoted islam, which is totally against what made America what it is today. Christianity had lots to do with America’s development, not islam.
